CREW Files Trade Comission FOIA for Records of Complaints of Dell’s “Next Day Service Plans”

Today, Citizens for Responsibility and Ethics in Washington (CREW) sent a Freedom of Information Act (FOIA) request to the Federal Trade Commission (FTC), seeking records related to complaints or investigations of “Next Day Service” plans offered by Dell Inc.(Dell). Numerous individuals and state law enforcement officials have complained that Dell did not provide next day service in spite of its representations. These complaints have resulted in a multi-million dollar settlement between Dell and 34 state attorneys general, as well as a New York court decision finding that Dell engaged in misleading and deceptive business practices. CREW expects the FTC may well have received similar complaints and, as explained in the request, the records requested are likely to contribute significantly to the public’s understanding of the complaints regarding Dell and the federal government’s response to this widespread problem.
