CREW Files FOIA Request for Fielding Memo
Today, CREW sent a FOIA request to the National Archives and Records Administration (NARA) seeking a memorandum issued by White House Counsel Fred Fielding concerning implementation of the Presidential Records Act. The existence of the memo came to light in CREW, et al. v. Cheney, et al., CREW's lawsuit concerning the failure of Vice President Cheney to comply fully with his record keeping obligations under the Presidential Records Act. Despite the court's ruling in that case that the memo was not subject to any privilege, the White House refused to release it to CREW, insisting instead that CREW depose a NARA official about the memo's contents.
