CREW Forwards DOJ Email Retention Policy Memos to National Archives

US National ArchivesWashington, D.C. - Today, CREW sent a letter to Paul Wester, director of NARA’s Modern Records Programs, forwarding to him portions of two memoranda CREW received recently in response to a Freedom of Information Act request to the Department of Justice’s Office of Legal Counsel (OLC). In February, Mr. Wester wrote to DOJ requesting a determination whether the absence of any email and computer records for certain former OLC officials, including John Yoo, was the result of an unauthorized destruction. DOJ has requested more time to respond, and in the interim CREW has secured two OLC memoranda that make it clear Mr. Yoo and others within OLC had an obligation to preserve all email important to understanding a decision of that office. CREW’s letter to Mr. Wester pointed out that the Obama administration’s efforts to usher in a new era of transparency and accountability require a full understanding of past practices, and urged NARA to make public all information it learns regarding the missing OLC emails.
