CREW Lawsuit Results in New Dep’t of Ed. Panel to Determine State Funding in “Reading First” Pro
Washington, D.C. - On August 10, 2009, United States District Court Judge Henry H. Kennedy, Jr. issued an opinion and Order in CREW v. Duncan, et al., CREW’s lawsuit based on the failure of the Department of Education to comply with the Federal Advisory Committee Act (FACA) in implementing its Reading First Initiative.
Judge Kennedy concluded the case was now moot because, as a result of CREW’s lawsuit, Education released over 62,000 pages of material related to the Reading First panel that made recommendations on state funding for Reading First and agreed to establish a new panel to replace the old panel. Judge Kennedy found that because the new panel has been chartered under and is complying fully with the FACA, there is no need to issue further declaratory or injunctive relief related to the actions of the old panel.
