Crew Sues Department of Education Over Refusal to Respond to FOIA Requests

Today, Citizens for Responsibility and Ethics in Washington (CREW) filed a lawsuit against the Department of Education based on the agency's pattern and practice of refusing to respond to CREW's Freedom of Information Act (FOIA) requests on the ground that they are not comprehensible and denying CREW a waiver of fees under the FOIA.

This pattern and practice began after CREW filed a complaint with Department of Education's Inspector General complaining about agency employee's use of outside email accounts to conduct official agency business and after CREW sued the Department of Education for violating the Federal Advisory Committee Act in its administration of the multi-billion dollar Reading First program.

The Department of Education has claimed, for example, that a FOIA request seeking email communications was not comprehensible at the same time that another agency processed an identical request.
