
BREAKING: Federal Magistrate recommends that Temporary Restraining Order be Issued Against White House in CREW's Email case
Major development today in the case, CREW v. Executive Office of the President.
Magistrate Judge John Facciola, issued a report and recommendation (found here under "Related Documents") in which he concluded that a temporary restraining order should be issued by District Court Judge Henry Kennedy preventing the White House from destroying any back-up copies – in whatever medium - created to preserve data.
CREW sought this order to ensure that back-up copies of the millions of email deleted from White House servers between March 2003 and October 2005 were preserved pending resolution of CREW's lawsuit challenging as contrary to law those deletions and the failure of the White House to have an effective electronic record-keeping system in place.The court refused to accept the last-minute proffer of the White House to provide a declaration in lieu of a court order, explaining that a declaration is not sufficient because a violation is not punishable by contempt. The White House has 10 days in which to file an objection to this recommendation, after which District Court Judge Henry Kennedy will issue an order.

Ethics
I am a licensed attorney who’s tired of reading about the unethical conduct and actions of attorneys, including Alberto Gonzales, Kyle Sampson, Monica Goodling, Hans von Spakosky, Ted Stevens, Lisa Murkowski and many others, who work in and for our government. News accounts of their actions in the US Attorney firings, the voter fraud matters, the Alaskan bribery and land deals and other matters present instance after instance of ethical lapses that range from violations of laws to conflicts of interest. To my knowledge, there is no organized effort to address these violations as grievable offenses. The Grievance Project is my effort to do exactly that.
My working list of attorneys whose conduct potentially violate their respective bars’ rules of professional conduct is up seventy-five (75) names. As time permits, I will continue to vet these attorneys and add posts for each attorney who I believe is committing grievable violations of their ethical obligations. I would appreciate any assistance you can give to the Project, including suggestions, critiques or publicity.
