25 Jan 2008 // Just days before their appellate brief is due on the issue of whether White House visitor records that the Secret Service has are agency records subject to the Freedom of Information Act (FOIA), defendants in CREW v. Dep't of Homeland Security filed a fifth declaration of Deputy Assistant Direct Paul S. Morrissey. Among other things, Mr. Morrissey identifies yet more categories of records that the Secret Service failed to search in response to CREW's FOIA request for visitor records for conservative religious leaders as well as responsive electronic data that until now the Secret Service has been destroying.

The filings can be found on the right.
