BREAKING: CREW Asks House Ethics Committee to Investigate Rep. Heather Wilson (R-NM)
As reported last night, Rep. Heather Wilson (R-NM) acknowledged that she did contact U.S. Attorney David Iglesias about a pending corruption case. Now that Rep. Heather Wilson (R-NM) has finally admitted to calling the New Mexico U.S. Attorney, Citizens for Responsibility and Ethics in Washington (CREW) has asked the House Committee on Standards of Official Conduct to investigate whether Rep. Wilson violated House rules by improperly contacting a sitting U.S. Attorney.
The U.S. Attorney in Albuquerque, New Mexico, David C. Iglesias, has stated that, in mid-October, two members of Congress from New Mexico pressured him about an ongoing corruption probe of state Democrats. Apparently, Rep. Wilson called Mr. Iglesias first and Sen. Pete Domenici (R-NM) called a week later. After Sen. Domenici admitted calling Mr. Iglesias, Rep. Wilson finally admitted yesterday that she too had called the U.S. Attorney.
Rep. Wilson’s call to Mr. Iglesias violates chapter 7 of the House ethics manual, which prohibits members from contacting executive or agency officials regarding the merits of matters under their formal consideration. House rules also state that if a member wants to affect the outcome of a matter in litigation, the member can file a brief with the court, make a floor statement, or insert a statement into the Congressional Record. Directly calling officials to influence an ongoing enforcement matter is not an option.
House rules also state that a member may not claim he or she was merely requesting “background information” or a “status report” because the House has recognized that such requests “may in effect be an indirect or subtle effort to influence the substantive outcome of the proceedings.”
Rep. Wilson’s conduct may also violate the requirement that members conduct themselves in a manner that “reflects creditably on the House.” In a precedent cited by the House ethics committee when it admonished former Majority Leader Tom DeLay (R-TX), the House has held that members are prohibited from asking an executive branch employee to engage in an activity having an impermissible political purpose.
CREW’s complaint alleges Rep. Wilson contacted Mr. Iglesias to discuss an ongoing investigative matter for the impermissible political purpose of harming Democrats in the November elections.
Melanie Sloan, CREW’s executive director, stated, “Reprehensibly, Rep. Wilson attempted to influence the criminal justice process for partisan political gain and then tried to hide her misconduct from public scrutiny.” Sloan continued, “Now that Rep. Wilson has finally come clean, it is time for the newly reconstituted House ethics committee to prove it is not merely a paper tiger and take swift action. Anything less undermines our criminal justice system.”

Heather Wilson should be made to resign or at least be forced to a runoff election against Patricia Madrid. And Senator Domenici should also be investigated and be forced to resign if evidence of criminal activity can be proven.

I can't believe all the criminal acts the Republicans commit and get away with. Yet, any slight questionable behavior by a Democrat, and they (Repubnicans) bring down the house. Just look at all the Constitutional and treasonous violations by GWbush(the Global Village Idiot) and yet there is no Democrat in Congress rallying for impeachment. Yet, President Clinton was impeached for lying under oath over a damn blow-job. Give me a break!
Democratic members of Congress better step up to the plate soon, or We The People will depose of them along with the criminally infested administration. Heather Wanted Iglesias to be a Team Player
I live in Heather Wilson's district and look forward to this leading to her departure in the next election. She clearly expected David Iglesias to help her win over her Democratic challenger, Patsy Madrid, by releasing indictments of Democrats before the election. Trying to use the legal system to game the electoral process is at least unethical and fits in with the Bush doctrine of doing anything to win. I do expect some key Democrats to be indicted, though not Patsy Madrid, and will be happy to see justice take its course. My respect for David Iglesias has increased greatly because he was willing to ignore very high level pressure from his own party (Pete Dominici and Heather Wilson) and held out for a methodical process. This did not help his career prospects.
Any politician who does not support a system of justice free from political interference does not deserve to be in office. Neither does any politician who expects voters to believe that they were not trying to influence the process by calling Iglesias just before the election. When a senator or a congresswoman is on the other end of the line inquiring about the status of the case, there is no need for them to overtly ask for anything. The phone call itself says it all.
