President Donald Trump’s use of an advisory committee composed of both federal employees and non-governmental individuals to obtain advice on potential Supreme Court justice nominations appears to violate the Federal Advisory Committee Act (FACA), according to a letter sent today by Citizens for Responsibility and Ethics in Washington (CREW) to White House Counsel Donald McGahn. The letter requests that McGahn take all necessary steps to comply with the FACA, including making publicly available the committee’s “records, reports, transcripts, minutes, appendixes, working papers, drafts, studies, agenda, or other documents which were made available to or prepared for or by” the committee.
