Washington, D.C.—The Federal Election Commission (FEC) must act to enforce fines the 60 Plus Association failed to pay, according to a complaint filed today by Citizens for Responsibility and Ethics in Washington (CREW).

Following a 2014 CREW complaint alleging that 60 Plus failed to disclose that a Koch brothers’ dark money group paid it to run millions of dollars worth of political ads, 60 Plus agreed with the FEC to pay fines totaling $50,000 within 90 days. Not only has the deadline long passed, 60 Plus has only paid $5,000, or 10% of the fine.

“The FEC so rarely takes action against wrongdoers, it cannot let a group off the hook when it does take action,” CREW spokesman Jordan Libowitz said. “It doesn’t count as enforcement if it’s not enforced.”

60 Plus’ chairman, Jim Martin, has publicly stated that the group will not pay the remainder of the FEC fine that it voluntarily agreed to on June 2, 2016, and has instead “decided to contest” the remainder of the money it owes for breaking the law.

“It’s clear that the 60 Plus Association does not want to be held accountable for its actions,” Libowitz said. “The FEC shouldn’t need external pressure to ensure accountability, but that is the reality we find ourselves in.”
