Following Judge Merchan’s decision to delay former president Donald Trump’s sentencing in his New York hush money case, CREW president and former federal prosecutor Noah Bookbinder released the following statement:

“The Supreme Court just succeeded in delaying accountability for Donald Trump. Its disastrous and legally indefensible decision to give former presidents wide-ranging immunity provided Trump with a mechanism to push sentencing in his New York case until just before the election, leading Judge Merchan to appropriately postpone sentencing until after the election and allow the parties to litigate the issues the unfortunate immunity decision has raised.

Ultimately, though, this sentencing should and will proceed. This prosecution was not based on official presidential acts and will not be derailed by the immunity decision. Trump’s misplaced efforts to dispose of the case based on the immunity decisions should be quickly and comprehensively disposed of, and then sentencing should move forward, as it would for any other American. No one, not even Donald Trump, is above the law, despite the best efforts of his allies on the Supreme Court.”
