CREW’s work to protect election certification
CREW is committed to protecting the certification of the 2024 election, from making the case against election rule changes in a Georgia lawsuit and in major news outlets, to investigating and reporting on threats to certification.
In August, 2024 CREW released a report that identifies 35 rogue election officials across the country who have already refused to certify past election results and may be in a position to do so again. The report focuses on eight states where county officials have unlawfully refused to certify elections since 2020: Arizona, Colorado, Georgia, Nevada, New Mexico, North Carolina, Pennsylvania and Michigan. The report also identifies the legal remedies available to state and federal authorities, as well as voters, to protect the certification of the 2024 election.
In Georgia, the State Election Board (SEB) considered dozens and passed several last minute election rule changes—CREW has been following closely and has taken a leading role in pushing back. Our Deputy Chief Counsel Nikhel Sus and our Chief Counsel Donald Sherman testified to the SEB in opposition of two of these rules changes in August. CREW, along with ACLU of Georgia, Common Cause Georgia and Public Rights Project filed public comments against the rule changes.
CREW later filed an amicus brief on behalf of American historians making the case against the new rules. CREW also obtained records that revealed that the vast majority of public comments on the rules were in opposition.
CREW also filed a brief in the Georgia Supreme Court on behalf of the Cobb County Board of Elections and Registration in Eternal Vigilance Action v. Georgia along with co-counsel Caplan Cobb LLC, and Haynie, Litchfield & White, PC, which builds on a victory in the Fulton County Superior Court in Cobb County Board of Elections and Registration v. State Election Board. That ruling blocked the hand count rule, which would have required poll workers to hand count every ballot (not vote) cast following the close of polls on election night and would have created confusion and disorder in the post-election period, potentially disrupting the certification process.
CREW’s leadership has also appeared on cable news shows, including speaking with Rachel Maddow and Laura Coates to call attention to threats to election certification.
